When my client first contacted me from her property near Porto-Vecchio to discuss her project, I was not entirely certain about travelling to unfamiliar territory without the assurance that I could see it through to a successful conclusion. Her determination was clear; without children, she wished, together with her husband, to transform this immobilised asset. To continue living there whilst drawing on its value as available capital, for themselves and to pass on to their nephews and nieces. However, when she informed me that she had already commissioned a local court-appointed expert to assess the market value of her home, I immediately committed to assisting her. Family Split Ownership Structure & Financial Optimization

This matter was initiated within the context of a family succession by a partner notary. The owner, aged over ninety, wished to retain use of the property in her capacity as usufructuary, thereby allowing her to continue living at home under the conditions to which she was attached. The heirs, having become bare owners and residing abroad, preferred to secure liquidity without further delay in order to proceed with the division of these assets. The sale of the bare ownership at a discount then naturally emerged as the most suitable solution. From the purchaser’s perspective, the transaction encompassed several dimensions: a quality property investment acquired at a significant discount, alongside the prospect of undertaking a comprehensive renovation before returning it to the market.

Three steps – three transactions

It sometimes happens that the initial plan proves unsuitable. Selling a property through an occupied viager sale when it is likely to become unsuitable in the near future is a factor that warrants careful consideration. In this instance, the arrangement ultimately evolved into a cash sale, enabling the purchase of a property with a lift in a neighbouring town, better suited to accommodate the realities of ageing. It was within this new living environment that the original plan found its true purpose: an occupied viager sale for the duration of the sellers’ lives, secured by a lifetime annuity providing the desired income supplement. Each year, when it comes time to adjust the annuity, my clients share with me how profoundly and positively this decision has transformed their lives. For the purchaser, this investment—part of whose price is paid over time—will become a private residence when the moment arrives.
